TERMS AND CONDITIONS OF SERVICE
AIR TICKETING

• Note that we do not hold any seat subject to an individual confirmation and therefore, the fares are subject to change without prior notice.
• Fare quotes per pax (1 pax).
• Always ensure you carefully read the ticketing conditions as well as the fare rules as per the specific airline and routing.
• Any changes or cancellations are to be done 12 hours before departure at a fee or no fee guided by the ticket conditions.
• Always take note of your check-in time which we advise on at least 1 hour before your flight departure for domestic flights and at least 3 hours before departure time for international flights.
• We will be managing your online check-in from our side which is always open 24 hours before the flight departure depending on the Airline’s online check-in policies.
• Seat allocation is based on availability by the time we are booking you in or upon check-in as per the different carriers, please take note that for certain seat preferences, you will be requested to make an additional payment for that depending on the booking class as well as the airline.
• Ticket costs should be FULLY PAID before ticket issuance unless otherwise specified under prior agreements.
• Refunds on tickets can only be processed for unutilized tickets reimbursable after 30 days from the Date of Cancellation as per the IATA reconciliation Policy, Cancellation charges plus tax deductions apply. Partially utilized tickets are non-refundable.

HOTEL BOOKINGS AND TOURS

• Hotel booking or reservations is done to you upon making a 50% deposit, please take note that this may vary in some hotels where a booking is done by making a full payment to the specific hotel, therefore, we do not hold any rooms or run any booking until above is observed.
• Be advised that the hotel rates are subject to change without any prior notice and this only applies to unconfirmed or incomplete bookings as per some of the hotel’s policies.
• Upon completion of the total package cost, you will receive a congratulatory message as well as an email reading the same. This will then be followed by the hotel’s booking confirmation vouchers.
• The rates are quoted per person either as; Per person sharing a double room or a triple room, each person pays the quoted amount i.e., Per person sharing *2 or Per person sharing *3 Per person in a single room where each person in a single room pays the per person sharing rate plus a single room supplement.
• Please note that the quotes are guided by the different hotels’ policies in terms of infant/child/teen ages may vary as well as the room-sharing policies where in some hotels, we don’t have triple rooms.
• Room upgrades and discounts are done subject to availability as well as well as your frequent connecting number which is given to you by your destination management consultant.

PAYMENTS POLICY

• Payment Policy
• Thank you for choosing VISTAVOYAGE TRAVEL GROUP. To ensure a seamless booking experience, please take note of our payment policy outlined below:
• Booking Confirmation and Deposit:
• A 50% deposit is required to confirm your booking and to facilitate prior arrangements with hotels. This deposit also serves to secure your reservation.
• Payment Channels:
• All payments must be made through the following authorized channels:
• Direct bank transfers to our KES or USD accounts, details of which are highlighted on our Payment Advice Sheets. (You can access these details via an e-commerce QR code.)
• Mpesa Business Paybill, Business Till, or Business Number as specified on our Payment Advice Sheets. Note that direct mobile money transfers to any number not listed on our Payment Advice Sheets will not be the responsibility of VISTAVOYAGE TRAVEL GROUP.
• Money Gram and Western Union are accepted for all our international clients.
• Cheques addressed to VISTAVOYAGE TRAVEL GROUP should be ready at least 2 weeks before the actual travel date.
• A secure payment link for all international card payments.
• Payment Confirmation:
• Upon successful payment, all receipts and invoices will be generated by VISTAVOYAGE TRAVEL GROUP and automatically shared with you via email. Additionally, a payment confirmation SMS will be sent.
• International Clients:
• For our international clients, payments can be conveniently made through Money Gram, Western Union, or by using the secure payment link provided for all card payments. Please follow the instructions provided in our Payment Advice Sheets for these transactions.
• Important Note:
• VISTAVOYAGE TRAVEL GROUP will not be held responsible or answerable for any direct mobile money transfers made to numbers not explicitly listed on our Payment Advice Sheets.

CANCELLATION POLICY

• Notice of cancellation must be made in writing to us and the following scale of cancellation fees will be applied:
• 21-30 days before departure, 50% of total price.
• 8-20 days before departure, 25% of total price.
• Within 7 days before departure or withdrawal from a tour, no tour fee will be refunded.
• All purchases are subject to re-confirmation within 3 – 4 business days.
• The vendor reserves the right to modify the tour arrangement for the smooth operation of the tour.
• All Hotel and Tour Packages Payment Deposit Refunds are non-reimbursable however, they can be utilized within 6 months from the date of cancellation subject to the Hotel and Tour package Cancellation Penalty.

Interpretation and Definitions

Interpretation

The words in which the initial letter is capitalized have meanings defined under the following conditions. The following definitions shall have the same meaning regardless of whether they appear in the singular or the plural.

For these Terms and Conditions:

• Affiliate means an entity that controls, is controlled by or is under common control with a party, where “control” means ownership of 50% or more of the shares, equity interest, or other securities entitled to vote for the election of directors or other managing authority.

Termination

We may terminate or suspend Your access immediately, without prior notice or liability, for any reason whatsoever, including without limitation if You breach these Terms and Conditions.

Limitation of Liability

Notwithstanding any damages that You might incur, the entire liability of the Company and any of its suppliers under any provision of this Terms and Your exclusive remedy for all of the foregoing shall be limited to the amount paid by You through the Service or 100 USD if You haven’t purchased anything through the Service.

To the maximum extent permitted by applicable law, in no event shall the Company or its suppliers be liable for any special, incidental, indirect, or consequential damages whatsoever (including, but not limited to, damages for loss of profits, loss of data, or other information, for business interruption, for personal injury, loss of privacy arising out of or in any way related to the use of or inability to use the Service, third-party software and/or third-party hardware used with the Service, or otherwise in connection with any provision of this Terms), even if the Company or any supplier has been advised of the possibility of such damages and even if the remedy fails of its essential purpose.

Some states do not allow the exclusion of implied warranties or limitation of liability for incidental or consequential damages, which means that some of the above limitations may not apply. In these states, each party’s liability will be limited to the greatest extent permitted by law.

“AS IS” and “AS AVAILABLE” Disclaimer

The Service is provided to You “AS IS” and “AS AVAILABLE” and with all faults and defects without warranty of any kind. The laws of the Country, excluding its conflicts of law rules, shall govern these Terms and Your use of the Service. Your use of the Application may also be subject to other local, state, national, or international laws.

Disputes Resolution

If You have any concerns or disputes about the Service, You agree to first try to resolve the dispute informally by contacting the Company.

For European Union (EU) Users

If You are a European Union consumer, you will benefit from any mandatory provisions of the law of the country in which you are resident.

United States Legal Compliance

You represent and warrant that (i) You are not located in a country that is subject to the United States government embargo, or that has been designated by the United States government as a “terrorist supporting” country, and (ii) You are not listed on any United States government list of prohibited or restricted parties.

Severability and Waiver

Severability

If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law and the remaining provisions will continue in full force and effect.

Waiver

Except as provided herein, the failure to exercise a right or to require performance of an obligation under these Terms shall not affect a party’s ability to exercise such right or require such performance at any time thereafter nor shall the waiver of a breach constitute a waiver of any subsequent breach.

Translation Interpretation

These Terms and Conditions may have been translated if We have made them available to You on our Service. You agree that the original English text shall prevail in the case of a dispute.
